Mediation: An Overview
Generally:
Mediation is an informal, yet structured, participatory process where we serve as an impartial third party assists disputing parties in resolving conflict through the use of specific communication and negotiation methods. Mediation works best when all participants in mediation actively participate in the process. Mediation is a voluntary process that can avoid the delay and cost of formal litigation and court process. Mediation is voluntary and confidential. Anything you discuss in mediation is between you, the other parent, and the mediator. It is important to note that allegations of child abuse or other threats are not confidential.
Divorce and Custody Mediation:
Domestic relations mediation is a way for you and the other spouse/parent to create your own separation and parenting plan. The mediator will not give legal advice or make the parenting plan for you; the parties decide what the separation/parenting plan should be. If the parents agree to a parenting plan, it may then, upon the filing of an action, become a court order if the jurist approves.
